Terms of Sale

These Terms of Sale apply when you purchase a digital product from The Simplified Self. Please read them before purchasing. By placing an order, you agree to the version of these Terms made available to you before or at checkout.

1. About us

The Simplified Self is operated by Chloe Newson trading as The Simplified Self, ABN 40 798 146 686, a sole trader based in Victoria, Australia.

Email: admin@thesimplifiedself.com
Post: PO Box 7034, Warrnambool VIC 3280, Australia

In these Terms:

The Simplified Self, TSS, we, us and our mean Chloe Newson trading as The Simplified Self.

You and your mean the person purchasing a Digital Product.

2. What these Terms cover

These Terms apply to digital products and resources sold by The Simplified Self, including downloadable resources, printable products, audio, video, workbooks, card decks, self-paced courses and other digital educational content. These are referred to in these Terms as Digital Products. Unless the relevant product page expressly says otherwise, no physical product will be supplied or shipped. If a Digital Product has additional or product-specific terms, those terms will be clearly disclosed or made available before purchase and apply together with these Terms. Hosted courses, programs or other products involving accounts, extended access or additional functionality may also be subject to separate Course Terms or Product-Specific Terms disclosed before purchase.

3. Who can purchase

Our Digital Products are intended for adults and are not directed to children. You must be at least 18 years old to purchase a Digital Product from us.

4. Product descriptions

We aim to describe each Digital Product clearly and accurately before you purchase. The product page will set out the main features of the Digital Product, what is included, the format in which it is supplied and any material access or compatibility requirements that apply. Please read the product description before purchasing. Images, mock-ups and examples may show how a Digital Product can be used or displayed. They do not mean that physical items shown in an image, such as frames, devices, stationery or printed copies, are included unless the product description expressly says they are. Nothing in these Terms reduces our obligation to supply a Digital Product that matches its description or any other rights you have under applicable consumer law.

5. Orders and when a contract is formed

When you submit an order, you are offering to purchase the Digital Product on the terms shown to you before and at checkout.Your purchase is accepted when payment has been successfully processed and we send your order confirmation or make the Digital Product available to you, whichever happens first.

Before an order is accepted, we may decline it where reasonably necessary, including where:

  • payment has not been authorised;

  • we cannot lawfully supply the Digital Product;

  • there is reasonable evidence of fraud or misuse; or

  • an obvious technical or pricing error has affected the transaction.

If payment has been taken and we cannot accept or fulfil your order, we will refund the amount paid. We will not cancel an accepted purchase simply because we change our mind about the sale.

6. Prices, currency and payment

Unless clearly stated otherwise before purchase, prices are in Australian dollars (AUD). Before you complete your purchase, we will display the minimum total amount payable to us for that purchase, including any compulsory or unavoidable charges that we are required to include and can calculate at that time.

Your bank, card provider or payment service may separately charge currency-conversion, international-transaction or other fees. These charges are determined by that provider and are not charged by The Simplified Self. Payment is processed through third-party payment providers. We do not directly receive or store your complete payment-card details. If a Digital Product is offered using instalments or another payment arrangement, the total price, instalment amounts and payment schedule will be disclosed before purchase. By choosing an instalment plan, you authorise the relevant payment provider to process the agreed instalments according to the disclosed payment schedule until the purchase price has been paid, subject to any refund, cancellation, adjustment or other legal right that applies. If an instalment payment fails, we may contact you and give you a reasonable opportunity to correct the payment. For a hosted Digital Product, access may be temporarily paused where a properly due instalment remains unpaid after reasonable notice. Where the problem can reasonably be corrected, we will not permanently end access solely because of a failed payment without first giving you a reasonable opportunity to resolve it.

7. Digital delivery

Digital Products are delivered electronically. Depending on what you purchase, delivery may include:

  • an email containing access or download information;

  • access through a customer or course account;

  • a download page; or

  • another digital delivery method described on the product page.

Where a product is advertised as immediately available, we aim to provide access immediately or shortly after successful payment. Occasional technical delays can occur. If you have completed payment and haven't received access, please check your spam or junk folder and then contact admin@thesimplifiedself.com. We will take reasonable steps to restore access, correct the delivery problem or resend the relevant files. You are responsible for providing a working email address at checkout. If you notice that you entered an incorrect email address, contact us and we'll help correct it where reasonably possible. Download links may occasionally expire or stop working for security or technical reasons. Unless the product page clearly states otherwise, expiry of a download link does not by itself end your Personal Use Licence for files you have already lawfully downloaded. We recommend downloading and keeping your own copy of downloadable Digital Products. We do not promise to host downloadable files online indefinitely. If a download link has expired, contact admin@thesimplifiedself.com. Where we can reasonably verify your purchase and the relevant file remains available to us, we will take reasonable steps to restore or provide replacement access. Your consumer rights continue to apply.

8. Downloadable files and hosted access

Where a Digital Product is supplied as a downloadable file, we recommend downloading and keeping your own copy after purchase. Where content is hosted online, such as a self-paced course, the applicable access period will be stated on the product page before purchase. We do not promise permanent or "lifetime" hosted access unless that promise is expressly made and clearly defined before purchase. If we need to move hosted content to another platform during your stated access period, we will take reasonable steps to provide replacement access so you can continue to use what you purchased. If we can no longer provide material hosted content during an access period you paid for, we will provide an appropriate remedy having regard to the circumstances and your rights under applicable consumer law.

9. Devices, internet access and third-party platforms

Some Digital Products require an internet connection, a reasonably current web browser, a PDF reader, audio or video playback capability, or software capable of opening the relevant file type. You are responsible for having an internet connection and device or software reasonably capable of using the file type or access method disclosed on the product page before purchase. If you are unsure whether a Digital Product will work with your device or accessibility setup, you are welcome to contact us before purchasing. We use third-party technology providers to process payments, deliver files and host some content. Temporary outages or technical issues outside our direct control may occasionally affect access. If this happens, we will take reasonable steps to restore or provide alternative access. A Digital Product will be supplied in the format and with the material compatibility requirements described before purchase.

We cannot guarantee that an independent device manufacturer, operating system, application or platform will continue supporting the same file type or functionality indefinitely after purchase. A later change made by an independent technology provider does not automatically mean the Digital Product was defective when supplied. This does not affect your rights if the Digital Product was incompatible with the requirements disclosed when you purchased it or otherwise failed to meet an applicable consumer guarantee.

10. Personal Use Licence for Digital Products

This Personal Use Licence applies to Digital Products purchased from The Simplified Self unless, before purchase, the relevant product page clearly states that a different licence applies. Subject to these Terms of Sale, when we supply a Digital Product or access to it, we grant you a non-exclusive, non-transferable and non-sublicensable licence to use that Digital Product for your own personal, non-commercial use. Purchasing a Digital Product gives you permission to use it in accordance with this licence. It does not transfer ownership of the Digital Product or its intellectual property rights to you.

What you can do:

For your own personal, non-commercial use, you may:

  • access, view and use the Digital Product;

  • download files where we have made them available for download and save them to your own devices or personal digital storage;

  • make reasonable backup copies of downloadable files;

  • print printable files as many times as reasonably needed for your own personal use;

  • make reasonable format changes to help you personally access or use the Digital Product, including resizing content, enlarging text, changing a file format for your device, using accessibility software or adding private notes;

  • ask another person to help you access, format or print the Digital Product where reasonably necessary for your own use; or

  • provide a relevant printable file to a commercial printing service solely to produce copies for your own personal use.

A person or printing service helping you under these permissions may handle or temporarily store the relevant file only as reasonably necessary to provide that assistance or service. No separate licence is granted to them to independently use, reproduce, publish, sell, distribute or retain the Digital Product for another purpose. It is also fine if another person happens to see a Digital Product you are personally using or displaying. This does not give them permission to keep their own copy or use your purchase as their own. You may share an incidental photograph showing your Digital Product in use, including on social media, provided the content is not reproduced clearly or completely enough for another person to reasonably use it instead of purchasing their own copy.

This permission does not allow you to upload the Digital Product itself, a complete individual resource, full-resolution file or a substantially complete and readable page or card for others to access or use. It also does not allow a Digital Product to be reproduced as part of paid, sponsored or affiliate content, or content promoting another business, product or service, without our prior written permission.

What you can't do:

Unless we have given you prior written permission, or applicable law allows the use, you must not:

  • share, send, distribute or give downloadable Digital Product files to another person, except for the limited assistance and printing permissions above;

  • share an account, login, course access, private link or download link so another person can access a Digital Product purchased for you;

  • give printed copies of a Digital Product to another person for their ongoing use;

  • upload or make a Digital Product available through a website, social media account, online group, shared drive, file-sharing service, marketplace, membership, forum or other platform where another person could access, copy, download or use it;

  • sell, resell, sublicense, redistribute, republish, rent or give away the Digital Product or a substantial part of it;

  • copy, extract, adapt or repurpose a substantial part of protected content to create, distribute or sell another product, card deck, resource, template, course, download, publication or service;

  • use a Digital Product in providing counselling, coaching, consulting, education, training, wellbeing or another professional or commercial service to another person;

  • provide copies to clients, customers, students, participants, employees, groups, workplaces or organisations;

  • record, screen-record, reproduce or download hosted audio, video, course or other content unless we have provided a download option or given permission;

  • remove or obscure copyright notices, branding or attribution;

  • use The Simplified Self name, branding or visual identity in a way that suggests your own product, service, organisation or business is affiliated with, approved by or endorsed by The Simplified Self; or

  • use a Digital Product, or a substantial part of its protected content, to create a dataset, template library or competing resource, or to train, fine-tune or develop an artificial intelligence or machine-learning system for distribution or commercial use.

Nothing in these Terms gives The Simplified Self ownership of ordinary ideas, facts, concepts or practices that are not themselves protected by copyright or other intellectual property rights. Each purchase is licensed to one individual unless the relevant product page clearly states otherwise. Your purchase does not include additional licences or copies for family members, friends, clients, customers, students, participants, groups, workplaces or organisations. If another person would like their own copy or access, they will need to purchase their own licence unless we have agreed to another arrangement in writing.

You may personally use, show or discuss a Digital Product as part of counselling, healthcare, coaching or another support service that you receive.

For example, you may show a resource to your psychologist, counsellor, doctor, coach or another support professional on your device or screen for the purpose of discussing your own use or experience. This does not give that professional permission to retain the Digital Product as a reusable resource, reproduce it for other people, distribute it or add it to materials they use in providing services. © 2026 Chloe Newson trading as The Simplified Self. All rights reserved. Copyright and other intellectual property rights in original TSS written content, original design and layout, branding, selection, arrangement and compilation remain with Chloe Newson trading as The Simplified Self, to the extent those rights are owned by The Simplified Self. A Digital Product may also contain photographs, fonts, illustrations, audio or other material used under licence from third-party rights holders. Rights in that material remain with the relevant rights holders. Your purchase does not give you a separate right to extract or reuse third-party material contained within a Digital Product, except where applicable law permits that use or you separately hold the necessary rights or permission. Nothing in this Personal Use Licence restricts any right, exception or use that cannot lawfully be excluded or restricted by agreement. Professional, group or commercial use. The standard purchase price does not include a practitioner, professional, group, workplace, organisational or commercial licence. If you would like to use a Digital Product in services you provide, with clients or groups, within a workplace or organisation, or for another purpose outside this Personal Use Licence, please contact admin@thesimplifiedself.com. Any additional permission or licence must be agreed in writing before that use begins. If your purchase is cancelled and you receive a full refund, or payment is finally reversed so you are no longer required to pay for the Digital Product, your Personal Use Licence for that Digital Product ends. You must then stop accessing and using the Digital Product and, where reasonably practicable, delete or destroy copies within your possession or control. You may retain material only to the extent reasonably necessary to exercise or evidence a legal right, resolve a dispute, comply with a legal obligation, or where applicable law otherwise permits you to retain it.

This does not limit any legal right or remedy.

11. Educational nature, accuracy and reliance

The Simplified Self provides wellbeing education, information and gentle self-guided practices. Our Digital Products are not therapy, counselling, medical care or a substitute for individual professional advice or treatment. Purchasing a Digital Product does not create a psychologist-client, therapist-client, counsellor-client, doctor-patient, coaching or other professional care relationship between you and The Simplified Self. Digital Products are created for a general audience and cannot take your individual health, circumstances, history or support needs into account. Different people can respond differently to the same information or practice. We do not guarantee a particular emotional, physical, psychological or wellbeing outcome. We take reasonable care when preparing educational Digital Products, but research and professional knowledge can develop over time. Unless a product expressly includes ongoing updates, purchasing it does not mean every piece of information will be continuously updated forever. If we identify a material error in a current Digital Product, we may correct it in accordance with Section 18. Nothing in this section reduces a representation we made about the Digital Product when you purchased it or any applicable consumer guarantee.

12. Our 14-day goodwill refund policy

We offer a 14-day goodwill refund window on paid Digital Products. If you change your mind or decide the Digital Product isn't right for you, you may request a full refund within 14 days of purchase. You do not need to provide a detailed explanation. Email admin@thesimplifiedself.com. We aim to respond to refund requests within two business days. If a full refund is approved for a purchase being paid by instalments, any remaining instalments for that Digital Product will be cancelled and amounts already paid towards that purchase will be refunded. Once a refund has been processed by us, the time taken for the funds to appear in your account depends on your payment provider and financial institution. Our 14-day goodwill policy is an additional promise from The Simplified Self. It does not replace or limit any rights you have under the Australian Consumer Law or another consumer law that applies. After 14 days, the goodwill window closes. Your consumer-law rights continue to apply. Our separate Refund Policy provides further information.

13. Consumer guarantees and problems with a Digital Product

If the Australian Consumer Law applies to your purchase, you automatically have consumer rights that cannot be excluded, restricted or modified by these Terms. Depending on the nature of the Digital Product and what has been supplied, applicable consumer guarantees may concern matters such as acceptable quality, fitness for a disclosed purpose, matching description, due care and skill or supply within a reasonable time. If a Digital Product does not meet an applicable consumer guarantee, you may be entitled to a remedy. Depending on the nature and seriousness of the failure, remedies may include rectification or re-supply, replacement, refund or cancellation, and compensation for reasonably foreseeable loss or damage where the law provides for it.

Where we are legally entitled to fix a minor problem first, we will do so within a reasonable time. Where the law gives you the right to choose the remedy, these Terms do not take that choice away from you. We will not rely on the expiry of our 14-day goodwill refund period to deny a consumer right that continues to apply by law.Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

14. EU and UK customers

If you are purchasing from the European Union or United Kingdom, mandatory consumer rights that apply to your purchase continue to apply. Certain online purchases carry a statutory withdrawal or cancellation period. For qualifying digital content supplied immediately rather than on a tangible medium, applicable law may allow supply to begin during that period where you expressly request or consent to immediate supply and acknowledge the effect this has on your statutory withdrawal or cancellation right. Where this rule applies, we will obtain the required consent and acknowledgement before beginning immediate supply. Where required, confirmation will be provided in your order confirmation or another durable form you can save. If the legal requirements for loss of a withdrawal or cancellation right have not been satisfied, nothing in these Terms removes that right. Our separate 14-day goodwill refund policy continues to apply even where you have validly agreed to immediate digital delivery and lost a separate statutory withdrawal or cancellation right.

15. Access suspension and material breaches

For hosted Digital Products, we may temporarily suspend or end access where reasonably necessary because of:

  • a material breach of the Personal Use Licence or these Terms;

  • fraudulent or unlawful use;

  • a serious security risk;

  • a final payment reversal that leaves the Digital Product unpaid; or

  • a legal requirement that prevents us from continuing access.

Where the problem can reasonably be corrected, we will generally contact you and give you an opportunity to resolve it before ending access. We may act immediately where reasonably necessary to address fraud, security or a legal obligation. We will exercise these rights reasonably and proportionately. This does not permit arbitrary cancellation and does not affect non-excludable consumer rights.

16. Liability

Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. To the extent permitted by law, we are not responsible for loss or damage to the extent it is caused by circumstances for which we are not legally responsible, including:

  • use of a Digital Product in a way that materially conflicts with its instructions or safety information;

  • unauthorised sharing, alteration or commercial use;

  • a device, internet connection or software issue outside our reasonable control where the Digital Product otherwise meets its description and applicable guarantees; or

  • an event outside our reasonable control, except where applicable law makes us responsible

    Nothing in these Terms excludes responsibility for reasonably foreseeable loss or damage where applicable consumer law requires us to compensate you. Nothing limits liability for fraud, wilful misconduct or another liability that cannot legally be limited.

17. Privacy and transactional communications

We handle personal information in accordance with our Privacy Policy and applicable privacy law. Information needed to process your purchase may be provided to payment, checkout, email, hosting and digital-delivery providers where reasonably necessary to complete the transaction or supply the Digital Product. We may send transactional communications relating to your purchase, including receipts, access information, download links, important access notices and responses to support requests. These communications are separate from marketing. Purchasing a Digital Product does not, by itself, mean you agree to receive ongoing marketing emails.

18. Changes to Digital Products

We may correct errors, improve accessibility, update information or make reasonable improvements to a Digital Product over time. We will not use this clause to materially remove what an existing customer purchased or materially reduce paid hosted access during an agreed access period without providing an appropriate alternative or remedy. An update does not automatically entitle an earlier purchaser to every future edition, expansion or separately sold product unless we expressly say that it does. Your consumer rights continue to apply.

19. Changes to these Terms

We may update these Terms for future purchases where our products, technology or legal obligations change. The Terms applying to an existing purchase are the version you agreed to when that purchase was made. We will not retrospectively impose a material change on an existing purchase simply by publishing new Terms. If a change is required by law or you expressly agree to a variation affecting an existing purchase, the change will apply only to the extent permitted by law.

20. Complaints and support

If something has gone wrong, please contact us so we have the opportunity to help.
Email:
admin@thesimplifiedself.com

We aim to acknowledge complaints within two business days and work to resolve them fairly and within a reasonable time. Making a complaint does not affect your consumer rights or prevent you from using another legal or regulatory pathway available to you.

21. Governing law and jurisdiction

These Terms are governed by the laws of Victoria, Australia. Subject to any mandatory law applying to you, you and The Simplified Self submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria, Australia. Nothing in this section removes a mandatory right, remedy or jurisdiction available under another applicable consumer law.

22. Severability

If a provision is found to be unlawful, invalid or unenforceable, it will be read down to the minimum extent necessary where legally possible. If it cannot be read down, it will be severed and the remainder of these Terms will continue to apply to the extent permitted by law.

23. Which terms apply to your purchase

Any mandatory law that applies to your purchase applies regardless of anything in these Terms.

Your agreement with us also includes:

  • any product-specific terms clearly disclosed before purchase;

  • the product description, inclusions and price presented when you purchased;

  • these Terms of Sale, including the Personal Use Licence; and

  • the Refund Policy made available at the time of purchase.

These documents should be read together.

If a product-specific term conflicts with these general Terms, the product-specific term applies to that Digital Product to the extent of the inconsistency.

Nothing in a product-specific term, product description, these Terms or the Refund Policy can exclude, restrict or modify a consumer right that cannot legally be excluded, restricted or modified. If our Refund Policy gives you a more generous voluntary refund or remedy than these Terms, we will honour that more generous commitment.
